Woman sues massage therapist, Baldwin City yoga collective; more sex-crime charges expected in criminal case

Aaron Paul Borger is accused of sex crimes against multiple women at Om Grown Yoga in Baldwin City between March 2024 and April 2026.

A woman has filed a civil lawsuit against a Baldwin City yoga studio and a massage therapist who worked there, claiming that the massage therapist committed sex crimes against her and that the collective was negligent in hiring and supervising him.

The civil suit comes on the heels of 11 criminal charges that the massage therapist — 44-year-old Aaron Paul Borger — was already facing, including seven felonies and four misdemeanors. The felony counts include two charges of rape and five counts of aggravated sexual battery. The misdemeanors include four counts of sexual battery. All of the charges relate to his work at the Om Grown Yoga Collective in Baldwin City and involve several female customers, as the Journal-World has reported.

On Wednesday, Borger’s criminal defense attorneys, Branden Smith and Hatem Chahine, told Senior Judge Nancy Parrish that even more charges were expected and asked her to delay a status conference in Borger’s case until July 22.

The female plaintiff in the civil suit has the same initials as one of the alleged victims in the criminal case, and she alleges similar nonconsensual touching, including rape, on the same date, April 3 of this year. Her petition requests a jury trial and for “fair and reasonable” compensatory and punitive damages to be awarded.

The petition against Borger and Om Grown, 816 High St., lists four counts: negligence on the part of both defendants, negligent hiring and supervision on the part of Om Grown, negligent infliction of emotional distress, and violation of the Kansas Consumer Protection Act.

The suit alleges that Borger was unqualified to perform massages, that he posed safety risks to clients and that Om Grown “concealed its knowledge of the dangers.” The plaintiff, who reported the incident to police, alleges that Om Grown had received complaints about Borger touching clients in offensive ways and that Om Grown was vicariously liable for Borger’s conduct.

“As a direct result of Defendants’ negligence, Plaintiff sustained medically diagnosable and significant emotional distress and injury,” the suit says.

The plaintiff is represented by the Kansas City, Missouri, law firm of Dollar, Burns, Becker & Hershewe LLC.

Borger is being held in the Douglas County Jail on a bond of $500,000.

Court records indicate that the defendants have yet to respond to the civil lawsuit, which was filed at the end of May.
