Pair accused in Lawrence Memorial Day shooting to have separate trials

A man and woman charged with attempted first-degree murder of a man after a Memorial Day shooting on U.S. Highway 59 will not have a joint jury trial after appearing before Douglas County District Court Judge Peggy Kittel on Friday afternoon.

Originally scheduled to face a jury together, Brittany Nicole Smith, 22, of Eudora, and Edward Joseph “E.J.” Parker, 25, of Lawrence, will have separate trials after Smith’s attorney requested to separate her case from her codefendant’s and her arraignment was pushed to a later date Friday.

Smith and Parker were arrested on suspicion of involvement in the shooting of 24-year-old Lawrence man Skylar L. Workman around 11 p.m. May 26. Workman was driving southbound on U.S. 59, just south of Lawrence. Workman suffered gunshot wounds and was flown to Stormont-Vail Hospital in Topeka.

Smith was supposed to enter a plea Friday, but instead will enter a plea at her new arraignment date, Sept. 26. Parker pleaded not guilty at his arraignment July 17.

Kittel also decided that statements Parker and Smith made to investigators during interviews before and after their arrests will be admissible in court. Parker’s attorney, Michael Clarke, argued that detectives’ actions unfairly influenced Parker’s statements, but Kittel disagreed.

“The court sees nothing that leads this court to believe the defendant was coerced into giving the statements,” Kittel said. “This court finds statements were made freely, voluntarily and intelligently.”

Parker’s jury trial is set to begin Sept. 15. Smith’s trial will not be set until after she is arraigned.

At their first court appearance in June, Smith and Parker were ordered not to contact each other. They are being held in the Douglas County Jail — Smith on a $75,000 bond and Parker on a $150,000 bond.
