Kansas Supreme Court overturns reduced sentence for man convicted of having sex with 2 children

? The Kansas Supreme Court has reversed a Shawnee County district judge’s decision to impose a reduced sentence on a man convicted of having sex with two children.

In a decision announced Friday, the court reversed and remanded to the Shawnee County court the sentencing of Harold Dean Spencer, who was 75 when he pleaded guilty in June 2008 to two charges of having sex with the children.

The Topeka Capital-Journal reported that District Court Judge Matthew Dowd, who has since retired, “abused his discretion” in departing from mandatory sentencing minimums when he placed Spencer on three years of supervised probation.

Another Shawnee County judge will now determine sentencing for Spencer.
