Lawsuit over Ellis County wind farm regulations dismissed

? A lawsuit against the Ellis County Commission over wind farm regulations has been dismissed.

More than two dozen landowners and a prospective developer had sued the county in November. The Hays Daily News reports that the lawsuit was dismissed on Wednesday.

The dismissal comes after the commission this week approved changes to zoning regulations for wind development projects.

The commission approved changing the required setback distance from 10 times the tip height to 1,000 feet, and eliminating regulations for noise levels.

In addition, the notification and protest petition area was reduced from 2,000 feet to 1,000 feet.
