Man to be tried on capital murder charge

? A prosecutor says he won’t seek the death penalty against a northeast Kansas farmer accused in the death of a 58-year-old woman.

Roger Hollister of rural Sabetha pleaded not guilty Wednesday to a charge of capital murder after Atchison County District Judge Martin Asher bound him over for trial. The judge set the trial for Nov. 30.

Hollister, 58, is accused of killing Patricia Kimmi, who disappeared last Nov. 6 from her home in Horton. Kimmi’s remains turned up in May on property in Nemaha County owned by Hollister’s brother.

KNZA-FM reports Atchison County Attorney Gerald Kuckelman took the death penalty off the table at the request of Kimmi’s family.

Hollister remains jailed. He’s accused separately of trying to kill his own wife earlier this year by driving into the path of a tractor-trailer. She survived.
