Topeka A hearing has been postponed indefinitely for a Kansas prosecutor facing a professional ethics complaint over past investigations of abortion providers.
The Disciplinary Administrator’s office said Tuesday that prosecutor Stephen D. Maxwell’s hearing won’t be held March 23-24 as planned.
The administrator’s office filed a complaint last year with the Board for Discipline of Attorneys. It alleges misconduct by Maxwell while he was an assistant attorney general from 2003 to 2007 and an assistant Johnson County district attorney in 2007-2008.
The complaint alleges Maxwell misled others to further investigations of abortion providers. Maxwell denies the allegations.
An attorney for Maxwell confirmed the delay in the hearing but wouldn’t comment further.

Our judicial system is corrupt.
This *delay* runs parallel to the federal prosecutors case at the federal supreme court level...framing by a prosecutors to get a conviction.
A certain ex-asst da from dg co heads that ethics board.....he assisted in the justifiable homicide outcome for the LPD in the Sevier coverup...

So...reading between the lines, Maxwell, whose hearing was set to be first, is now pushed back until after Kline and Rucker. That could mean that the Disciplinary Administrator believes that Maxwell will provide testimony implicating Kline and Rucker, and further that by placing Maxwell last, heat will be put on Kline and Rucker to confess all or face the possibility of being caught lying or lacking in candor to the Disciplinary Board and earning even more significant sanctions. Remember, while a right against self-incrimination exists, except when explicitly invoked, "it is a separate professional offense for a lawyer to knowingly make a misrepresentation or omission in connection with a disciplinary investigation of the lawyer's own conduct."

Allegations against Kline include misconduct, trial publicity, rules dealing with prosecutorial responsibilities, the safekeeping of property, conflict of interest, lack of candor toward a court and lack of truthfulness in statements to others. Kline lied to the Kansas Supreme Court, misled a Johnson County grand jury investigating an abortion provider and discussed an ongoing case on "The O'Reilly Factor," a conservative talk show, the complaint said.
The complaint against Rucker alleges he violated rules prohibiting making a false statement to a tribunal, offered evidence he knew to be false, and engaged in misconduct, including conduct involving dishonesty and conduct prejudicial to the administration of justice.
