Garland ? A coal surface mine near Garland is included on a list of 48 mines that a California congressman says are potentially dangerous.

Rep. George Miller, a Democrat from California released a list of the mines Wednesday that he says have not been scrutinized because of a delay in assessing safety violations.

The mine in Bourbon County has been owned by the Phoenix Mining Company since May 2003.

The U.S. Department of Labor says the mine has been been cited 162 times since March 2008.

Robert Hartley, co-owner of the Oklahoma-based Phoenix Mining, says the company has had some minor safety violations since 2008, when federal mining policy changed. He says many of the citations are unfair and the company is challenging several of them.
