Dismissal of charges in homicide sought
A decision is expected next week on a Kansas City, Mo., man’s request to dismiss a charge in connection with a 20-year-old homicide case.
On Thursday, Eric Montgomery, 75, was in Leavenworth County District Court as his defense argued that a charge of aiding a felon should be thrown out.
Montgomery’s attorney told Judge Gunnar Sundby that the case couldn’t stand alone because of immunity granted to Montgomery in another murder case in 1992. And Montgomery’s defense attorney, Debra Snider, said the statute of limitations has expired.
Montgomery testified in July 1992 in the murder case of Everett Bishop under an order of immunity. Sherrill Gary Brinkley is serving time for Bishop’s murder.
The current charge against Montgomery is related to the killing of Lloyd Folsom, which occurred two weeks before Bishop’s murder.
Prosecutors argue that Montgomery aided Bishop in Folsom’s killing in April 1990. Montgomery was arrested at his home last month on the current charge.
Sundby is expected make a decision within a week.
