Lawrence man pleads in stolen bank card case

A Lawrence man reached a plea agreement with prosecutors in a theft case Tuesday, one day after his jury trial had begun.

Richard E. Elston Jr. entered an Alford guilty plea and was convicted of one felony count of attempted criminal use of a financial card related to charges that he broke into a Lawrence apartment Nov. 24 and used a stolen bank card at Wal-Mart.

The plea means he does not admit guilt but acknowledges that prosecutors, based on evidence presented, could convince a jury to reach a guilty verdict.

He also had faced aggravated burglary and theft charges, which were dropped in exchange for the plea. According to the agreement, the defense and prosecution will ask Douglas County District Court Judge Michael Malone to sentence Elston to serve 13 months in prison after he serves 32 months for a January conviction related to a Eudora burglary last fall.

Elston faces another trial June 4 in Douglas County on charges that he committed a Nov. 23 burglary while out on bond awaiting trial for the Eudora burglary.

Malone on May 31 will sentence Elston on Tuesday’s conviction.
