Topeka An abortion doctor will ask the Kansas Supreme Court to investigate Atty. Gen. Phill Kline and Bill O'Reilly over the Fox News Channel television host's comments that he obtained information from Kansas abortion records, the doctor's attorneys said Saturday.
The attorneys said Dr. George Tiller wants the court to appoint a special prosecutor to handle the investigation and take possession of the records of 90 patients from two clinics, including Tiller's. They said he will make his requests Monday.
During a national Friday night broadcast of "The O'Reilly Factor," the host said a "source inside" told the show that Tiller performs late-term abortions when a patient is depressed, which O'Reilly deemed "executing babies." He also said his show has evidence that Tiller's clinic and another unnamed clinic have broken Kansas law by failing to report potential rapes with child victims aged 10 to 15.
O'Reilly interviewed Kline, but Kline spokeswoman Sherriene Jones said Saturday that the attorney general doesn't know how O'Reilly obtained his information.
Tiller's attorneys, Pedro Irigonegaray, of Topeka, and Lee Thompson and Dan Monnat, of Wichita, issued a joint statement decrying the "national media event."
"The fears about threats to the sanctity and privacy of medical records were well-grounded," they said.
O'Reilly did not say whether his information came from the records of 90 patients from Tiller's clinic and a clinic operated in Overland Park by Planned Parenthood of Kansas and Mid-Missouri. Kline waged a two-year battle to obtain those records and received edited versions of them Oct. 24.
It wasn't clear Saturday whether O'Reilly's source had broken state or federal laws by divulging patients' information or whether O'Reilly or his staff had viewed any records themselves. A request to Fox News in Washington to interview O'Reilly or someone associated with his show wasn't answered Saturday.
"We don't know anything about Mr. O'Reilly's inside source," Jones said. "I assumed he was talking about somebody on the inside of the abortion clinics."
Asked about the possibility that TV host's information came from a clinic insider, Irigonegaray said, "That's preposterous."
Patient privacy has been a major issue as Kline seeks his second term against Morrison, the Johnson County district attorney. Morrison has repeatedly criticized Kline for seeking abortion clinic records, saying it invaded patients' privacy.
Kline has received national attention for his pursuit of the records, and Planned Parenthood's national organization listed him as one of 15 "anti-choice extremists and political hard-liners."
Kline says he's not investigating any patient, only potential rapists and doctors who may have broken Kansas' abortion laws. He maintains that patients' privacy has been protected.
"Phill Kline told us these records would be kept private, but now that Phill Kline has them, the host of a national talk show Kline is on says he has seen the records," said Mark Simpson, Morrison's campaign manager. "O'Reilly would not be claiming to have seen the private medical records of Kansans if Phill Kline had not violated Kansans' privacy by seizing the records."
Irigonegaray said in an interview that he was outraged both by O'Reilly's remarks and by Kline's failure to demand answers from the television host about where he received his information. Irigonegaray said the records contain no evidence of wrongdoing by the clinics.
"This has been our concern from the beginning, that if he ended up with these records, that just this type of event would occur. Our worst nightmare has happened," Irigonegaray said. "Women in America deserve better than this."
Kline confirmed this week that he'd received the records from Shawnee County District Judge Richard Anderson, edited so that individual patients could not be identified.
Kline said he's turned the records over to staff who are reviewing them to prosecute possible cases of child rape, forcible rape, incest, illegal late-term abortions, failing to report sexual abuse of a child and making a "false writing."
"There's only a limited number of people within the attorney general's office who have access to those records, and I can assure you that none of them have shared that information beyond the investigators and prosecutors who are reviewing the cases," Jones said.
O'Reilly told viewers Friday night that his program has been investigating Tiller for a year. Now, he said, it has evidence about abortions in Kansas.
Kline suggested during his interview that O'Reilly inferred that late-term abortions had been performed for mental health reasons, given that state statistics show none have been performed to preserve a woman's life or to prevent permanent damage to a physical bodily function, two other reasons they are allowed.
O'Reilly replied: "Our information says that on almost every medical sheet - and obviously we have a source inside here - it says, 'depression.' I don't know whether you have that information or not - I don't know - but that's what it says."
Kline avoided an unprecedented contempt citation from the Kansas Supreme Court in February, after the clinics complained he'd violated a gag order in the case that Anderson imposed. The high court criticized Kline but said it would give him the benefit of the doubt.
Anderson subpoenaed the records at Kline's request in September 2004, concluding there was probable cause to believe they might contain evidence of crimes. The clinics asked the Supreme Court to intervene.
While Anderson had not planned to give Kline unfettered access to the records, the Supreme Court imposed new guidelines for handling them and sent the case back to district court. Anderson received the records in August and turned them over to Kline two months later.
In the frequently bitter race, Morrison has received the bulk of Kansas newspaper endorsements.
On Friday, The Junction City Daily Union endorsed Morrison, calling Kline "a social activist who has questionable relationships with the churches that agree with his extreme political views."
But The Topeka Capital-Journal endorsed Kline on Saturday, saying, "We believe Kline's efforts to protect all Kansans have outweighed the controversies stemming from his personal politics."

Those who support Kline seem to forget the fact that being the anti-choice abortion chaser is NOT part of his job description. His job is to protect consumers which he has been doing a very very poor job of. His contributors are the same business organizations that he is supposed to be prosecuting.
A mental health exception is a legal and morally justified reason for a late term abortion. There is no news here other than the fact that he revealed to O'Leilly the contents of the sealed documents.

In accordance with the Federal Privacy Law (HIPAA), abortion clinics keep medical information and records confidential and will only use them for patient treatment, health care operations, and billing purposes.
Treatment: Physicians, clinicians, and staff will use your medical information to give you the best possible care.
Health Care Operation: Abortion clinics will use this information for appropriate follow-up care, patient notification, statistical & regulatory requirements, and internal quality assurance programs.
Billing Purposes: Abortion clinics will use your medical information to bill the appropriate third party(ies) for your care.
disclosure of information with extenuating circumstances
1. Health information will be given to family members in case of an emergency or under other circumstances with proper authorization and documentation.
2. Health information may be given to other physicians or institutions under emergency situations.
3. Information may be given to proper authorities when neglect or abuse is alleged or suspected.
4. Information may be provided to courts or other agencies when a subpoena is given to this office.
Patient Rights
Effective April 14, 2003

Limits on Use of Personal Medical Information. The privacy rule sets limits on how health plans and covered providers may use individually identifiable health information. Civil and Criminal Penalties. Congress provided civil and criminal penalties for covered entities that misuse personal health information. Criminal penalties apply for certain actions such as knowingly obtaining protected health information in violation of the law. Criminal penalties can range up to $50,000 and one year in prison for certain offenses; up to $100,000 and up to five years in prison if the offenses are committed under “false pretenses”; and up to $250,000 and up to 10 years in prison if the offenses are committed with the intent to sell, transfer or use protected health information for commercial advantage, personal gain or malicious harm.

Were O'Reilly and/or his staffers accessing these private patient records, for purposes of actually providing health care? Last I heard, Bill O'Reilly was not a licensed physician. I wouldn't know about any of his staff members.
If O'Reilly and/or his staffers committed an offense against HIPAA by accessing these records… were the offenses “committed with the intent to sell, transfer or use protected health information for commercial advantage, personal gain or malicious harm?”
November is generally referred to, in the TV industry… as a “Sweeps” month. O'Reilly and Fox would certainly have a commercial advantage over their competition, based on the sensational nature of these medical records.
Of course, O'Reilly could just be *saying* he has the records… when he really doesn't; then, I guess some would have to wonder about his credibility.

It's highly doubtful any employee of Tiller's provided any records to Bill O'Reilly unless they were a mole for Operation Rescue. The highest likelihood is that either O'Reilly lied or a staffer of Klines did it while he was “looking the other way” so he could deny any knowledge of it. It's the sleazy, “right up to line of illegality” type thing he is known for doing. However O'Reilly got them, IF he got them, he admitted on national TV to violating HIPPA regulations. He needs to answer for it. The man makes me ashamed to admit I'm Irish American.

But…
*If* O'Reilly is to be believed… he said that his folks had been digging into the Tiller clinic for a year, maybe more. That's well in advance of Kline getting his hands on the redacted records.
If somebody in the clinic leaked documents to Fox, then it will come down to a violation of HIPAA vs. a “reporter” protecting their source(s).

Patriotman, Democrats will NOT shut up until the republicans get it through their dense heads that to save lives, you CAN'T outlaw abortions when a mother's life & health could be at risk & continue the Bible thumping against stem cell research when there is NO medical proof (via DNA or scientific papers) that stem cell research is the same thing as cloning. it is not! Conservatives, your arguments against Stem Cell Research & abortions don't wash anymore. Both issues deal with life & death consequences. You say you support saving human life & protecting unborn babies, then how can you say that you support life when you are against Stem Cell Research that could cure diseases like that of Michael J. Fox? I laugh at your arguments. hahahaha!

right_thinker, I remember seeing some of these photos back in the '70s and '80s. I was raised Roman Catholic; there was generally a big, flat table at the back of the church, with tons of these kinds of pamphlets laid out. Children (like myself back then) weren't restricted from picking them up and looking at them.
One year—the '90s midterms, I think—the fashionable tactic of doctor murders (that would be the proper term for somebody like James Kopp or Eric Robert Rudolph, wouldn't it, Marion? ) and extremist opponents of choice, was to register as a candidate for office, *any* office. School board, county clerk, dog catcher… anything. Then, they'd make up these TV ads…. script generally went something like this:
[opening head/shoulders shot]
“Hi, my name is John Franklin, and I'm running for dog catcher in the 12th precinct. I'd appreciate your vote on November 5th. And now, I'd like to show you what I believe is America's biggest problem…
The rest of the ad was @ 20-25 seconds of slow-motion video footage, all kinds of blood, gore… Hollywood horror movie stuff. Pounding techno music in the background, like from one of the chase sequences in a “Friday The 13th” movie.
Those ads were all over the place, especially 5:30-7:00pm, when there were most likely children in front of the TV, waiting for dinner to be served.
Speaking of Hollywood and movies, right_thinker: How do you know that the photos you're seeing are the real deal? You can do wonders with white Karo syrup, egg whites, water… bottle of red food coloring.
Can't say I'm fazed by the “shock show” tactics.
“IT”… is hysterical… nasty… and in pretty poor taste. But that's okay, I'm used to over-the-top stuff from narrow-minded extremists. ;)

P.S. Next time you're up for gratuitous blood & guts kinda stuff, forget the stale ol' fake abortion photos, and try something like “Hostel.” At least you get a halfway-decent story line, a bit of suspense.

Well, Republicans you need to be scared, because your Attorney General of Kansas (not mine) gave an illegal order to invade patients' privacy rights by illegally obtaining their medical records at abortion clinics without proof that laws were broken. abortions are NOT illegal. Hogwash. The unborn do not have any legal rights, anywhere in the country. Try again.
Exactly how dignified is it to spread one's legs and have an unborn child implanted through their vagina? And yet I think that it is still considered a private act. People who have sex don't expect to have records of it, especially film at 11, appear suddenly later.
Whether you like it or not, abortion is legal. It's considered a medical procedure, and as such, is protected by HIPPA laws. How many men would be crying foul if the records of their ED treatment were made public, and Bill O'Reilly got a copy?
As for Kline, if he were any kind of AG, he'd doing an investigation himself, to see if O'Reilly's claims are true, and how he got the records if they are true.
Kline's job is to protect and enforce the laws we already have, not to be the poster child for anti-abortion groups. He can have any opinion he likes, in the privacy of his home. In public, it is not his job to go on a witch hunt against everyone he perceives to be pro-abortion.
That is NOT his job. I repeat, that is NOT his job.
Come tomorrow, I will do my part to get Kline out of public office.
