Convicted killer faces resentencing, life in prison

? A man convicted of participating in a November 2002 robbery and killing in Garden City will be resentenced because of a Kansas Supreme Court ruling Friday, but he still could spend the rest of his life in prison.

The court’s unanimous ruling upheld the first-degree murder conviction for Ngan Pham, also known as “Bam-Bam.”

But the court struck down five of his six aggravated robbery convictions and a conviction for conspiring to commit kidnapping.

That might not change the bottom line much for Pham, serving his time at the state prison outside El Dorado. He was sentenced to serve life plus 108 years and 10 months, and the life sentence remains intact.

Pham was the third person sentenced to prison for the robbery and killing.

A jury concluded Pham and two brothers were the three masked gunmen who entered a Garden City home and tied up the six family members who lived there.

One, Thang Nguyen, was shot while trying to escape.

Pham challenged his murder conviction on several grounds. He challenged the admission of his statements because English is not his primary language and an interpreter wasn’t provided for him.

However, the court noted that Pham had lived in the United States for more than two decades and that he understood English well enough to understand a statement of his rights as a defendant.

Also, the court noted, the agent asked Pham whether he wanted an interpreter and, “Pham stated that he did not need one.”
