No charges to be filed in 2-year-old’s death

The Jefferson County attorney will not file any charges related to a Feb.14 accident in an Ozawkie parking lot that killed a 2-year-old, a Kansas Highway Patrol spokesman said.

Lt. John Eichkorn said the highway patrol received a statement Thursday from the Jefferson County Atty. Mike Hayes. In the statement Hayes said his office reviewed the accident report and determined that circumstances of it would not establish a criminal case.

Two-year-old Michael Brown fell from the back seat of the 1992 Pontiac Bonneville that was backing out of a restaurant parking lot, according to the accident report. Troopers said none of the seven occupants in the vehicle wore seat belts, including the driver, 15-year-old Tyler Schultz.

Brown’s father, also named Michael, had said he believed his son squirmed out of his seat belt and got out of the car while it was backing up.

A spokeswoman in Hayes’ office said Friday the county attorney does not comment on the status of cases or possible cases.
