Man accused of killings tries to withdraw plea

? After pleading guilty last month to killing his two young sons in a burning travel trailer, a Liberal man has filed a motion to withdraw his plea.

Bob Fox entered guilty pleas on two counts of second-degree murder in the deaths of Rowdy Fox, 4, and Chance Fox, 6, both of Hooker, Okla. The two boys died March 27, 2004, during a weekend visit with their father.

His motion to withdraw the plea will be heard Aug. 29, the same day Fox was scheduled to be sentenced, said Jan Lunsford, a spokesman for the Kansas attorney general’s office.

The fire was initially considered an accident, but Seward County Atty. Don Scott eventually charged Fox with two counts of first-degree murder. One of the counts was later upgraded to capital murder, allowing prosecutors to seek the death penalty.

His first trial was declared a mistrial on Feb. 3, a day after it began, when Fox’s defense team said it had not received a copy of a report on the fire that appeared to have been lost.
