Cloud County attorney: Fatal shooting justified

? The fatal shooting of a man by two Concordia police officers last month was justified, the Cloud County attorney’s office said Wednesday.

Theodore M. Lavoie, 46, was shot to death on Sept. 22 when officers tried to arrest him on a warrant related to a domestic battery charge. The shooting was investigated by the Kansas Bureau of Investigation, and the county attorney’s office said its reports were reviewed by the Kansas Attorney General’s Office.

In a statement released Wednesday, County Atty. Robert Walsh said the officers were justified because they reasonably believed they needed to defend themselves against imminent use of deadly force by Lavoie, who was holding a shotgun. Walsh said no criminal charges would be filed.

According to the report, Lavoie lowered the barrel of the gun at one point but said that if he needed to shoot the officers to get out, he would.
