Domestic dispute sparks car chase that kills two

? Two brothers were jailed after a car chase that stemmed from a domestic dispute ended in a crash that killed a man and woman, police said.

The victims were identified as Topeka residents Byron Birch, 23, and Keona Emanuel, 22, who died a few hours apart Friday at a hospital. They were injured Thursday night when a car driven by Birch was rear-ended by a larger car and slammed into the side of a house.

Two other passengers in Birch’s car also were injured. Emanuel’s 3-year-old son, whose name was not released, had nonlife-threatening injuries, while Walter S. Divers, 39, was more severely injured, police said.

Police on Friday arrested Cleon Tyrone McKinney, 32, and his brother Reginald “Reggie” Leroy McKinney, 34, on two counts each of reckless but unintentional second-degree murder, two counts of aggravated battery and one count of child endangerment, said Kristi Pankratz, police public information officer. The McKinneys were booked into Shawnee County Jail.

Cleon McKinney is the father of Emanuel’s 3-year-old son, and the chase Thursday night stemmed from a domestic dispute, police Maj. John Sidwell said.

According to police, Birch was driving west in a Mitsubishi Diamante sedan that went out of control and struck a house after it was rear-ended a 1997 Cadillac driven by Reginald McKinney.

No one was in the rental home at the time, but resident Masala Cavazos arrived moments later. She said Friday she was haunted by the images of Emanuel and Birch bleeding.

“I just can’t stop thinking about the lady and the driver,” Cavazos said. “That was a bad wreck.”

Cavazos said the car smashed a hole in the block foundation, cracked the wall and ceiling of the kitchen and bent several steel poles that protect the home from cars backing out of the parking lot of a nearby business.

Sidwell said police were investigating how fast the two cars were traveling. The Mitsubishi sustained heavy damage, and the Cadillac had minor damage, police said.

Cleon McKinney had been awaiting sentencing next month in U.S. District Court in Topeka, according to police and court records. He pleaded guilty in March to conspiracy to possess controlled substances with the intent to distribute.

According to court records, McKinney and another man delivered 3.7 pounds of powder cocaine to a law enforcement agent at a Topeka motel in March 2003. Authorities said McKinney fled when told he was under arrest, leading police on a chase that ended when he wrecked the car he was driving.

Reginald McKinney was released on probation July 26 from a federal prison where he had been held following a 2002 conviction for felony possession of a firearm, according to court records.
