Mission rescinds liquor sales on Sunday

Council accepts protest petition

? The City Council pulled the plug on Sunday liquor sales and decided against conducting a special election on the issue.

The council on Wednesday accepted a protest petition to block the sales. That petition nullifies the ordinance the council passed in July to allow Sunday liquor sales, said City Administrator Mike Scanlon.

The liquor stores would have been open on Sunday for the first time on Oct. 5.

But Councilman Steve Schowengerdt submitted the protest petition last week.

Only council members Phil Perry and Suzie Gibbs voted in favor of a special election.

“I am for business,” Gibbs said. “I think it’s discriminatory when you say you can go anywhere in Mission and buy a drink on Sunday, but you can’t buy a bottle of wine. I think that’s wrong.”

The council voted in July to approve liquor sales on Sundays, as well as on Memorial Day, the Fourth of July and Labor Day. The petition opposes only Sunday sales.

The movement toward Sunday liquor sales began in November, when Kansas City, Kan., and Edwardsville opted out of the state’s liquor laws, citing home rule statutes. A Wyandotte County judge in March affirmed the rights of those cities to exempt themselves from the ban on Sunday sales.

State authorities, however, disagree and have appealed to the Kansas Supreme Court.

Shawnee repealed its Sunday sales ordinance in September in response to a protest petition.

Lawrence, Topeka, Overland Park, Prairie Village, Roeland Park, Merriam, Leawood and Lenexa, also have approved Sunday liquor sales.
