Probation lawsuit alleges misconduct

? A Kansas City woman has filed a lawsuit claiming she spent nine months in prison because she rejected her probation officer’s sexual advances.

The Johnson County, Kan., probation officer, Randall Nester, is already facing criminal charges and at least one other lawsuit for alleged sexual misconduct involving women he was supervising.

The latest lawsuit, filed May 9 in Jackson County Circuit Court, alleges that Nester had Pasha Walton’s probation revoked after she refused to show him her breasts during an after-hours office visit. The incident allegedly occurred in a Kansas City office operated by the Johnson County Department of Corrections.

The Kansas corrections department and the Johnson County Commission are also named as defendants in the lawsuit, which alleges that county officials were negligent in hiring and supervising Nester, who no longer works for the department.

Don Jarrett, chief legal counsel for the Johnson County Commission, said Friday the county would vigorously defend the lawsuit.

The lawsuit does not seek a specific amount of damages, but in an earlier letter to county officials, Walton’s lawyers asked for $350,000 to settle.

According to the lawsuit, Walton, 33, was on probation for forgery and obstruction of legal process in October 2001 when Nester propositioned her.

When she refused and left the office, Walton was “terrified” that Nester might retaliate against her.

In January 2002, a judge, acting on Nester’s recommendation, revoked her probation.

“Ms. Walton’s fear was justified,” her lawyers wrote.

She was in prison for nine months until Johnson County court officials became aware of sexual misconduct allegations against Nester and ordered her release in October.
