Panel seeks Sunday liquor sales ban

? A House committee has endorsed a bill to ban Sunday sales of packaged liquor statewide, a move intended to close what a court said was a loophole in the state’s existing prohibition.

The House Federal and State Affairs Committee voted 12-9 Tuesday to send the bill to the full House, after rejecting a proposal to let local governments legalize Sunday sales if voters approved.

The bill also would make sales of packaged alcohol legal in cities and counties unless their governing bodies vote to prohibit such sales.

A state official told the committee Monday the entire Liquor Control Act was jeopardized by last week’s court ruling that some of its provisions did not apply uniformly to all Kansas cities and counties.

The Kansas Constitution allows local governments “opt out” of nonuniform laws using their power of home rule.

The ruling, by a Wyandotte County judge, upheld the right of the city of Edwardsville and the Unified Government of Wyandotte County and Kansas City, Kan., to opt out of the section of the act banning Sunday liquor sales.

Other cities and counties might follow suit unless the Legislature revises the Liquor Control Act to make it uniform, Division of Alcohol Beverage Control director Bob Longino said Monday.
