Anhydrous ammonia legislation OK’d

Senate gives initial approval to bill that protects farmers from theft liability

? Senators tentatively approved a bill Wednesday to protect farmers and other businesses from lawsuits by people who steal anhydrous ammonia from them and are injured by the explosive fertilizer.

Anhydrous ammonia is an ingredient in methamphetamine, making tanks of it prime targets for theft by people who manufacture the illegal drug, said Senate Agriculture Committee Chairman Derek Schmidt.

The bill advanced on a voice vote, and final action was scheduled for today. Passage would send the measure to the House.

Supporters said some farmers and businesses that store large quantities of anhydrous ammonia have difficulty obtaining insurance.

Insurance companies are concerned that thieves will be injured or killed handling the fertilizer, possibly leading to lawsuits for damages, said Schmidt, R-Independence.

The bill would make owners of anhydrous ammonia liable only for “willful, wanton, reckless or intentional conduct.”

Critics said the bill would create unusual protection for a special interest.
