Judge considering whether Tommy May, convicted in 2018 shooting, should get a new trial

A judge will make a ruling later this month on whether a man convicted in a shooting that injured two people should get a new trial.
Tommy May, 61, of Lawrence, was convicted on several charges after a jury trial in December 2019, including attempted first-degree murder, attempted second-degree murder, aggravated battery on a law enforcement officer and more.
The charges stem from a rapid series of events on the evening of July 2, 2018. The jury found that May shot a woman in the face, injuring her; shot a man, leaving him paralyzed from the waist down; then fled the scene and accelerated his SUV toward a Lawrence police sergeant who had pursued him. May was taken into custody shortly thereafter and has remained in the Douglas County Jail since.
On Tuesday, Douglas County District Court Chief Judge James McCabria heard testimony from some witnesses who said they had heard other information about the case. One said the man who was shot told him that the incident was a robbery attempt “gone south,” which corroborated May’s version of events. Another witness said the woman who was shot was dishonest and violent.
Prosecutors argued that much of what was presented Tuesday had already come out at May’s trial — or it could have, because it wasn’t new information — and none of the testimony or other claims in the defendant’s motion merited a new trial.
McCabria said he will review transcripts from the trial and will pronounce his ruling on Monday, Nov. 30.
