Lawrence City Commission agenda set for July 17 meeting

Consent agenda

1. Approve City Commission meeting minutes from 07/10/18.

2. Receive minutes from various boards and commissions:

3. Approve all claims. The list of claims will be posted by the Finance Department on Monday prior to the meeting. If Monday is a holiday, the claims will be posted as soon as possible the next business day.

4. Approve licenses as recommended by the City Clerk’s Office.

5. Adopt on first reading, Ordinance No. 9485, removing the 4-way STOP at 18th Street and Indiana Street.

6. Adopt on second and final reading, Ordinance No. 9516, making certain findings; authorizing the issuance of general obligation bonds or temporary notes of the City to finance an economic development grant to the Lawrence Humane Society, Inc.

7. Adopt Resolution No. 7256, declaring the City’s intent to issue General Obligation Bonds in the amount of $200,000 for the purpose of traffic calming, utilizing speed humps on Missouri Street, from 8th to 9th Streets; Arkansas Street, from 8th to 9th Streets; Lincoln Street, from 3rd to 7th Streets; West 24th Street, from Crossgate Drive to Kasold Drive; and traffic calming, utilizing a bicycle boulevard on 13th Street, from Massachusetts Street to Haskell Avenue.

8. Approve an extension of an approved Site Plan, SP-16-00155, per Section 20-1305 (o) of the Land Development Code, for a commercial development located at 4300 W. 24th Place.

9. Accept dedication of easements associated with Minor Subdivision, MS-17-00704, for Fairfield Apartments Addition No. 1, located at 2115 Exchange Court. Submitted by CFS Engineers P.A., on behalf of BJ North County Medical Dental Center LLC and Southwind Capital LLC, property owners of record.

10. Accept dedication of easements associated with a Final Plat, PF-18-00222, for Maple Street Subdivision, 772 and 782 Maple Street. Submitted by BG Consultants, for Lawrence Kansas Rentals LLC, property owner of record.

11. Accept dedication of drainage easements associated with Minor Subdivision, MS-18-00118, for West Lawrence Addition No. 2, located at 432 Indiana Street. Submitted by Grob Engineering Services, for C.F. Abercrombie, property owner of record.

12. Approve a Text Amendment, TA-18-00150, to the City of Lawrence Land Development Code, Articles 4, 5, 9 and 17 to define certain types of storage uses; Mini-Warehouse, self-storage, climate controlled self-storage and similar uses and to permit some uses in the IBP (Industrial/Business Park) District and adopt on first reading, Ordinance No. 9514. 13. Authorize the City Manager to execute Engineering Service Agreements with George Butler Associates Inc (GBA) and Professional Engineering Consultants (PEC) for a total of five watermain replacement projects.

14. Approve City of Lawrence Parks and Recreation Advisory Board bylaws as recommended for approval by the Parks and Recreation Advisory Board on a 3-0 vote Tuesday, July 10, 2018.

15. Authorize an extension through October 31, 2018 for Bert Nash Community Mental Health Center to execute an agreement with the City of Lawrence for the Bridges Transitional Recovery Program facility project, a recipient of Housing Trust Funds (Affordable Housing Advisory Board recommends approval 7-0).

16. Authorize the Mayor to sign a Release of Mortgage for Donna J. Williams and Jean E. Dixon, 1601 Kenwood Drive.

Regular agenda

1. Conduct public hearing to consider a vacation request submitted by Landplan Engineering for Gary Woodland, to vacate a 30-foot drainage easement along the east side of Lot 1, Fall Creek Farms 12th Plat, also known as 104 N. Wilderness Way.

ACTION: Conduct public hearing and approve Order of Vacation request, if appropriate.

2. Consider the following items related to the 2018 Live on Mass #3 event to be held in the 1000 block of Massachusetts Street on Friday, September 21, from 6:00 p.m. to 11:30 p.m.:

a) Conduct public hearing to consider a distance limitation waiver request and consider adopting on first reading, Ordinance No. 9511, allowing the sale, possession, and consumption of alcohol in the 1000 block of Massachusetts Street on the public right-of-way during the event; and

b) Consider approving a Special Event Permit, SE-18-00291 in the 1000 block of Massachusetts Street and 1020 Massachusetts Street, submitted by Mike Logan, The Granada.

ACTION: Conduct public hearing and find that the proximity of the temporary sale of alcoholic liquor for the 2018 Live on Mass #3 event is not adverse to the public welfare or safety and grant a distance limitation waiver; adopt on first reading, Ordinance No. 9511; and, approve a Special Event Permit, if appropriate.

3. Consider a Text Amendment, TA-18-00154, to the City of Lawrence Land Development Code, Article 13 to review and potentially remove the ability to zone property with conditions. Initiated by City Commission on 4/17/18. (PC Item 7; The PC passed a motion, by 8-1 vote, to retain the existing code language thereby maintaining conditional zoning in the Land Development Code 5/23/18.)

ACTION: Receive presentation and provide direction to staff, if appropriate.

4. Consider authorizing publication of the 2018 amended budget summary and establishing August 7, 2018 as the public hearing date.
