Attempted burglary leads to arrest early Friday

Lawrence police responded to a call early Friday about a man threatening another man with a gun through the window of an apartment in the 2900 block of West Seventh Street.

The victim knew the suspect, Capt. Bill Cory said, and police arrested the suspect on charges of aggravated attempted burglary.

Cory said police had not confirmed if the suspect had a weapon and that the incident was still being investigated as of 1:30 a.m. Police were called about 12:30 a.m.

so, if I'm reading this correctly.... The victim was holding the suspect at gunpoint. that's balla.

An arrest made for "aggravated attempted burglary" would suggest it's the burglar whom the police found armed with a gun.

21-5807. Burglary; aggravated burglary. (a) Burglary is, without authority, entering into or remaining within any:

(1) Dwelling, with intent to commit a felony, theft or sexual battery therein;

(2) building, manufactured home, mobile home, tent or other structure which is not a dwelling, with intent to commit a felony, theft or sexual battery therein; or

(3) vehicle, aircraft, watercraft, railroad car or other means of conveyance of persons or property, with intent to commit a felony, theft or sexual battery therein.

(b) AGGRAVATED burglary is, without authority, entering into or remaining within any building, manufactured home, mobile home, tent or other structure, or any vehicle, aircraft, watercraft, railroad car or other means of conveyance of persons or property IN WHICH THERE IS A HUMAN BEING with intent to commit a felony, theft or sexual battery therein.
