Douglas County prosecutors file battery charge against Leavenworth man accused of injuring Lawrence woman

Douglas County prosecutors have re-filed an aggravated battery charge against a 41-year-old Leavenworth man accused of injuring a 46-year-old Lawrence woman in an April domestic disturbance.

According to court records, prosecutors on Sept. 2 filed a new case charging Shane L. Maxwell with one count of aggravated battery. A case against him in connection with the alleged incident was filed earlier this year, but prosecutors dismissed it in July. Maxwell had a first appearance in court Wednesday and posted $20,000 bond.

In the new case, prosecutors accuse Maxwell of injuring the woman during an altercation April 25 in the 2500 block of Morningside Court. Lawrence police have said the two were involved in a domestic argument, and Maxwell was accused of injuring the woman, who suffered broken ribs and bruising to her arms and legs.

According to court records, prosecutors initially filed an aggravated kidnapping count because she alleged he took her somewhere against her will, but a judge ruled there was no probable cause and dismissed that count.

Maxwell’s next hearing on the aggravated battery charge is scheduled for Oct. 19 in front of District Judge Michael Malone.
