Matthew Jaeger takes stand in his own defense

2:45 p.m. Back in session, but Judge Fairchild is adjourning court until 9 a.m. Friday. Defense has two expert witnesses who are traveling from out of town, but they are not here yet, Irigonegaray said.

Defense will present witnesses tomorrow. Fairchild said jury instructions and closing arguments will likely be Monday.

2:25 p.m. Attorneys are done questioning Vogel.

2:15 p.m. Irigonegaray: Would it be fair to call the injuries as you saw them as mutilation of her vagina?

Vogel says no because tissues are very forgiving and heal quickly because of how vascular the region is.

2:10 p.m. Vogel says Jaeger’s ex-girlfriend’s injuries are “very compatible” with a straddle injury. He also says that blunt force trauma cannot rule out a straddle injury.

1:50 p.m. Vogel says he reviewed medical records of Jaeger’s ex-girlfriend in the case. Doctor says he also asked for as much medical information as possible prior to the injury.

1:45 p.m. For the jurors, defense attorney Pedro Irigonegaray is having Vogel talk through his qualifications as a doctor and expert witness.

1:30 p.m. Defense calls Dr. Edward J. Vogel, an obstetrician and gynecologist.

1:25 p.m. Jaeger says he licked his hands in police interrogation video only because a substance had formed a layer on his hands after police did a DNA swab.

Wright finishes her cross-examination. Defense attorneys say they have no other questions for Jaeger. He steps down from the stand.

1:20 p.m. Back in session. Jaeger still under cross-examination. Wright is asking Jaeger about his ex-girlfriend getting into his car.

At 11:50 a.m., Chief Douglas County District Judge Robert Fairchild adjourns court for lunch. Assistant Attorney General Nola Wright will resume cross-examination of Jaeger at 1:15 p.m.

11:45 a.m. Jaeger says he went to ex-girlfriend’s apartment that night because he was worried: “I was concerned that due to her past and knowing her risky behaviors that she could possibly be in situation that was harmful to her, and I was concerned.”

Prosecutor: Did you call the police?

Jaeger: No

Did you call her brother ?

No I didn’t

Prsoecutors asks him if he took it upon himself to try to help her.

“I went to go and make sure that she was OK, yes.”

11:40 a.m. Jaeger says on Oct. 9, 2007, he was concerned for ex-girlfriend because she sent him text about friends trying to get her drunk. Also on a phone call he couldn’t talk to her, but heard the phone drop or other side was muffled.

“I didn’t get any reply, I didn’t know what was going on,” Jaeger said.

11:20 a.m. Sorry for confusion earlier. Assistant Attorney General Nola Wright is cross-examining Jaeger. I wrote “not” instead of “now.”

Wright is asking Jaeger about text messages between him and his ex-girlfriend about their relationship.

Wright asked him if in 2007 she indicated she was “done with him.”

“Throughout our relationship there were always times when we were done with each other. We just ended up still hanging out,” Jaeger said.

Jaeger has also said he was the one who broke off their relationship because he believed they both needed to evaluate their lives. He said they were still “best friends.”

10:50 a.m. Jaeger tells prosecutor he wasn’t truthful with police because he had not been in police interrogation room before.

“I was in police station in that specific room I’ve never been in a situation like that before.”

10:45 a.m. Irigonegaray ends his direct examination of Jaeger by asking about phone messages he left for ex-girlfriend that night.

Jaeger: “Sitting here I’m abosolutely embarrassed and ashamed for those phone message. I shouldn’t be talking to anybody like that. I’m sorry. It’s embarrassing to sit here and listen to them.”

Assistant Attorney General Nola Wright will now cross-examine Jaeger, rather another attorney will.

10:30 a.m. In exchange with defense attorney Pedro Irigonegaray:

Irigonegaray: Once you ran out of her apartment, did you every go back in?

Jaeger: I did not

Irigonegary: Once she came out of the apartment, did you see her go back up to the apartment?

I did not

Did you ever strangle her?

I did not

Did you ever punch her?

No, I did not.

Did you do anything to hurt her?

I did not.

10:20 a.m. Jaeger says as he entered ex-girlfriend’s bedroom, she said she fell on a bed railing. Jaeger says he was confused because a man jumped off the balcony. He chased after him.

His ex-girlfriend later tells Jaeger it was her friend and that everything was OK.

Jaeger denies going back into apartment. He denies strangling, punching or hurting his ex-girlfriend at all.

10:10 a.m. Jaeger says he and his ex-girlfriend had sex at his home Oct. 8, 2007.

The next evening, he was out with his friend, Evan Carroll. Said he had a message from his ex-girlfriend about someone trying to get her drunk.

He went over there to try to help her.

9:50 a.m. As the Matthew Jaeger’s defense team begins presenting its case, Jaeger has taken the stand as the first witness.

Jaeger has already said he was not truthful in his statement to Lawrence police the night he was arrested and accused of injuring his ex-girlfriend in Lawrence.

Jaeger says he was trying to protect his friend, Evan Carroll, from getting a DUI. He also said he broke into the apartment because he was concerned that he heard his ex-girlfriend crying and a man screaming.

Prosecutors accuse Jaeger of injuring his ex-girlfriend on Oct. 9, 2007, because she was with another man, Dylan Jones.

“I was in a horrible situation at that point in time. I had never been in that situation before,” he said.

Jaeger said he will explain what happened that night to jurors later.

Now Jaeger is recounting his relationship with his ex-girlfriend that began in 2005 and eventually turned sour near the beginning of 2007.
