Preliminary hearing in shooting is Monday

A 35-year-old Baldwin City man accused of shooting his neighbor in the head is scheduled to have his preliminary hearing Monday in Douglas County District Court.

Brian L. Pitts faces a felony aggravated battery charge related to the Aug. 2 shooting.

Daniel T. Sumner, 32, was taken to Kansas University Hospital by helicopter ambulance with a bullet wound to the head. He was released Aug. 4. The shooting happened in the basement of Sumner’s home, in the 200 block of Elm Street. Police said numerous shots were fired, but only one grazed Sumner and tore back his scalp.

Pitts was arrested by Baldwin City police soon after the shooting. He was released from jail Aug. 6 on $75,000 bond and ordered not to have contact with the victim.

Pitts was originally scheduled to have a preliminary hearing in front of Douglas County District Judge Paula Martin on Wednesday afternoon, but it was continued until 9 a.m. Monday, court records show.
