Attorneys will make closing arguments Monday morning in a Douglas County murder and burglary trial.
Prosecutors rested their case Friday morning after presenting evidence for five days accusing Allen Dale Smith, of Topeka, of shooting Clarence David Boose, 77, during a botched burglary in April 2005 at Boose’s home near Lecompton.
Smith’s cousin, Leonard Price, has already pleaded guilty to felony murder in the case. He testified against Smith this week.
Defense attorneys have argued that Smith has an alibi, and the defense also rested its case Friday afternoon.
In August, a jury deadlocked in the case, causing a mistrial.
