Roommate testifies at hit-and-run hearing

Joshua Walton was worried after he heard someone had been hit by a car on Kentucky Street during the early morning of Sept. 23, his roommate said during testimony Friday in Douglas County District Court.

“It looks bad,” James Andrade quoted Walton as saying.

Walton, 24, is charged with involuntary manslaughter in the hit-and-run death of Ryan M. Kanost, 22, who was struck as he tried to cross Kentucky Street at 13th Street.

Walton turned himself into Lawrence police hours after the wreck. After questioning, he was released. He was arrested after being charged in December and is now free on $25,000 bond.

Judge Robert Fairchild continued Friday’s hearing to 1:30 p.m. Aug. 3. Walton’s attorney, Tom Bath, had an afternoon court hearing in another county.

The purpose of a preliminary hearing is for the judge to determine if there is enough evidence for Walton to be tried.

Witnesses on Friday said Walton had been drinking the night of the wreck.

Walton said he was driving on Kentucky and struck something with his car but didn’t see anything, Andrade said.

Andrade also testified that a girlfriend had given Walton a ride to their Lawrence residence. The car Walton had driven, a Toyota Camry, was parked downtown on Massachusetts Street when Andrade later examined it to see if it could be driven home.

The front passenger side of the car was dented and something had pushed against a wheel, making it undrivable, Andrade said. It also was leaking fluid.

Andrade said he also noticed a small red blot on the car and touched it with his finger, thinking it might be grease.
