Topekan resentenced in shooting death

A 32-year-old Topeka man convicted a decade ago of a shooting death outside a Lawrence night club received a new sentence Thursday.

Douglas County District Court Judge Michael Malone sentenced Damon L. McCray to 10 years in prison for voluntary manslaughter and criminal discharge of a firearm. But because McCray gets credit for time served in prison so far, he only has 203 days remaining on his sentence.

McCray was convicted of first-degree murder in the 1996 shooting death of Topeka resident Onzie Branch outside Langston’s, a club formerly at 806 W. 24th St. But he won a new trial in District Court last year after Malone found prosecutors had improperly withheld evidence before his first conviction.
