Released sex offender arrested

? A sex offender who was released from prison earlier this month because of a paperwork mix-up was arrested this week after allegedly attempting to rape a woman, Garden City police said.

Richard Molina, 42, of Garden City, was arrested Tuesday on allegations of attempted rape, aggravated sexual battery and felony obstruction after a 37-year-old woman reported that he tried to rape her, Garden City police Capt. Mike Utz said.

Molina first was arrested Nov. 8 at Tyson Fresh Meats Inc. when police confirmed he was a registered sex offender in Texas but had not registered after moving to Garden City in August.

He was released Nov. 22 from the Finney County Jail because the Finney County attorney’s office missed a deadline to file a criminal complaint, said Finney County Attorney John Wheeler.

The deadline for filing the complaint was Nov. 22. Deadlines to file complaints with the court are typically on Thursdays, but Nov. 22 was a Wednesday and the lawyer assigned to the case believed the deadline was still Thursday, Wheeler said.

Molina, who was being held on $80,000 bond, was released Nov. 22 because the complaint was not filed on time.

“The detectives did their job on the case and submitted (the affidavit) and it’s an unfortunate mishap that it did slip through the cracks,” Utz said.

Molina is being held in the Finney County Jail.
