Father found guilty of second-degree murder in DUI crash that killed his 9-year-old son

A 35-year-old Tonganoxie father was found guilty Thursday of second-degree murder and other crimes in connection with a DUI car crash that killed his young son.

The father, Shane Michael Degraeve, was also found guilty of three counts of aggravated endangering of a child in the Sept. 4, 2022, single-vehicle crash in rural Leavenworth County.

DeGraeve was driving a 2022 GMC Sierra 3500 pickup, the computer of which revealed that he was driving over 70 mph when he crashed near Easton Road and Kansas Highway 92. Degraeve failed to navigate the road and drove into a ditch, striking a sign and rolling his vehicle. Degraeve’s 9-year-old son, a passenger in the front seat, was not wearing his seat belt, was ejected from the vehicle and later died, according to a news release from the Leavenworth County attorney. The two passengers in the backseat, also children, were taken to an area hospital for treatment.

Law enforcement officers detected alcohol on Degraeve’s breath and observed signs of impairment. Degraeve told law enforcement he was run off the road, but that was contrary to witness statements and evidence, the release said. Degraeve did admit to having one beer, the release said. His blood alcohol level came back at .083, which is higher than Kansas’s legal limit of .08.

The truck also had two seat belt “silencers,” which prevent occupants from buckling into the vehicle, the release said.
