A Lawrence man pleaded no contest Wednesday in Douglas County District Court to burglary of a rural home in February.
Ulices Deaquino Altamirano, 20, was originally charged with felony aggravated burglary and misdemeanor theft but pleaded to one lesser count of felony residential burglary as part of a plea deal with the state.
The charge relates to an incident around 4:30 a.m. on Feb. 5, when Altamirano entered a house in the 1000 block of East 1400 Road, as the Journal-World reported.
Chief Assistant District Attorney Jennifer Tatum said that the homeowner heard someone in her residence and went to see who it was. The homeowner confronted Altamirano, who immediately fled the house. Altamirano was detained shortly afterward by law enforcement.
Tatum said the state believes that Altamirano has little to no criminal history that would affect his sentence and that he would likely qualify for probation under the Kansas sentencing guidelines. She said the additional theft charge would be dismissed as part of the agreement.
Judge Sally Pokorny scheduled Altamirano to be sentenced on June 9. Altamirano has been free on a $30,000 own-recognizance bond, meaning he was not required to put up any money to be released from jail but could be charged that amount if he fails to appear in court.
The Journal-World has requested Altamirano’s booking photo from the Douglas County Sheriff’s Office.
