Kansas City man charged with selling drugs that allegedly caused a fentanyl death in Douglas County

A Kansas City, Missouri, man was charged on Friday with selling drugs that allegedly led to a death in Douglas County.

The man, Daniele Francesco Leone, 32, faces one felony count of distribution of a controlled substance causing death, according to charging documents.

The charge is in connection with the fentanyl overdose death of Nickolas Joseph Byrum, 32, of Lawrence, who died on March 15, 2021. According to his obituary, Byrum was a father of four.

Leone is the second person charged in connection with Byrum’s death after Abby Gail Burton, 29, of Norborne, Missouri, pleaded guilty to possession of heroin as part of a plea deal, as reported by the Journal-World. Burton agreed to undergo drug treatment and to testify against Leone as part of her plea agreement.

Judge Amy Hanley sentenced Burton in August 2022 to 13 months in prison, that she then suspended to 12 months of probation, according to court records.

Leone was arrested on a warrant by Douglas County sheriff’s deputies around 2 p.m. Friday, and he is being held on a $75,000 cash or surety bond in the Douglas County Jail. He is next scheduled to appear in court on Jan. 17 for a status update.
