Lawrence man pleads no contest in gas station fight that left man with a serious head injury

A Lawrence man pleaded no contest on Friday in Douglas County District Court in connection with a fight at a gas station that resulted in serious injuries.

Xavier Micheal Wilson, 22, was convicted of one felony count of attempted aggravated battery as part of a plea agreement that lowered the charge from aggravated battery with a deadly weapon. The original charge was a level-7 person felony, and it was lowered to a level-9 person felony.

The charge is in connection with an incident on Aug. 23, 2022, in the 2200 block of Harper Street when police responded to a disturbance with weapons that was upgraded to a stabbing, as the Journal-World reported. The men knew each other and had a fight, after which Wilson was treated for stab wounds at a local hospital before his arrest later that evening; the other man was taken to a Kansas City-area hospital to be treated for serious head injuries, police said at the time.

Judge Amy Hanley said on Friday that Wilson faces five to 17 months in prison depending on his criminal history; if he does not have any significant convictions, he will be eligible for probation, in accordance with the Kansas sentencing guidelines.

Assistant District Attorney Christen Secrest said that when police arrived at the gas station on Harper Street the day of the incident, the victim told police that he and Wilson had been in a fight, but the victim was incoherent and police found him difficult to understand. The victim was clear, though, that Wilson had battered him.

Hanley then scheduled Wilson’s sentencing for March 31. Wilson is currently free on a $4,000 own-recognizance bond, meaning he was not required to put any money down to be released from jail but may be charged that amount if he fails to appear.

The other man involved in the incident has not been charged with a crime, according to court records.
