Man pleads no contest to lesser charges in Lawrence child sex crime case

A man pleaded no contest to two felonies Monday after initially being charged with seven counts of aggravated indecent liberties with children younger than 14.

Brian M. Kennedy, 45, was convicted of one count of aggravated battery, a level-4 felony, and attempted aggravated battery, a level-6 felony, during a hearing Monday afternoon in Douglas County District Court. Judge Stacey Donovan found that the crimes were sexually motivated, so Kennedy will have to register as a sex offender.

Kennedy most recently lived in Omaha, Neb., the Journal-World previously reported, but he was charged with crimes that reportedly occurred several years ago at his home in Lawrence.

Specific details of the allegations against the man were not clear. The court sealed the probable cause affidavit supporting Kennedy’s arrest. However, Assistant District Attorney Cathy Eaton said during Monday’s hearing that Kennedy inappropriately touched two young victims between 2013 and 2014.

As part of the plea agreement, and depending on his criminal history, Kennedy will likely face about five years in prison. He will be subject to post-release supervision.

Kennedy is scheduled to be sentenced on Sept. 28. He has remained in custody of the Douglas County Jail on $50,000 cash or surety bond since his arrest in May 2019, jail records show.

The Douglas County Sheriff’s Office declined to release Kennedy’s booking photo to the Journal-World when he was charged and after he pleaded no contest on Monday. Online jail records describe him as a 6-foot-tall white man with brown hair and blue eyes.
