Affidavit: Teen said friend’s father assaulted her after she fled fight with her own father

A 15-year-old girl headed for a friend’s house in Lawrence after a fight with her father, but there the friend’s father sexually assaulted her, she told police.

As a result of the accusation, Jimmy E. Scott, 43, was charged with one count of aggravated indecent liberties with a child, a felony. The charges, filed Nov. 28 in Douglas County District Court, allege that Scott engaged in lewd fondling or touching of the girl in March 2018.

The Journal-World requested the affidavit Lawrence police prepared in support of Scott’s arrest, and recently received it from the court. According to the document:

The teen reported the incident to police immediately after it happened. Police went to Scott’s apartment, where they found him, the victim and several of Scott’s family members before interviewing them all separately.

The girl told police that after fighting verbally and physically with her own father, she and her sister left the house and called a friend to come pick them up. The friend and Scott drove to get them, and they all returned to Scott’s apartment where they planned to stay the night.

The teen said everyone was dancing and listening to music, and that Scott was “drinking moonshine and smoked some marijuana.”

Later, she told police, Scott pulled her into a bedroom and told her, “you don’t have to be sad.” He then kissed her on the mouth, grabbed her buttocks and started kissing her neck, she said.

Then, she told police, he lifted her onto the bed, climbed on top of her and tried to remove her clothes, but she pushed him off and ran out of the room.

She said she ran to get her sister, and they locked themselves in the bathroom and called 911.

The sister told police that she saw the alleged victim go into the bedroom to talk to Scott, then “storm” out before pulling her into the bathroom. The sister said she’d known Scott for several years and that he had not ever made sexual advances toward her.

The sister said that while waiting for police, Scott told them he had ‘messed up’ and made statements about getting ‘too messed up’ from alcohol.

Scott, in a formal interview with police, denied the allegations.

He said he did give the girl a hug and tell her everything was going to be OK but that he “would never lock a door with an underage girl inside.” He vehemently stated that nothing else happened, banging his fist against the table multiple times before ending the interview, detectives noted.

Scott’s appointed attorney, Hatem Chahine, said the case was in early stages and declined to comment on the allegations for this article.

Scott was arrested Dec. 7 and remains free on $10,000 bond, according to court records.
