Lawrence man receives 47 months after January handgun incident

A 29-year-old Lawrence man was sentenced to 47 months in prison on Monday for aggravated battery and assault in connection with a January shooting.

District Judge Sally Pokorny sentenced Phillip Howard to 36 months for reckless aggravated battery and 11 months for aggravated assault with a handgun, both of which are felonies.

Howard was arrested after a Jan. 18 shooting at Peppertree Apartments, 3300 W. 22nd St. According to documents from the Douglas County District Attorney’s office, Howard allegedly fired a handgun at another person. A bullet traveled into the neighboring apartment where it hit a man in the thigh.

Howard pleaded no contest to both charges. He was originally charged with attempted first-degree murder but the charge was reduced.

Howard was also sentenced Monday to 12 months for theft and criminal damage to property in connection to a separate incident in 2012. The 12 months will be served concurrently with the assault and battery sentences.
