Alcohol involved in Oct. 19 accident

An accident report from an Oct. 19 incident in which a Lawrence man was run over by a vehicle provided additional details about the case.

According to the report, Elbert Davis Jr., 22, of Lawrence, had fallen face-down on North Seventh Street, just north of Ash Street. The report indicates Davis has medical issues and had been drinking alcohol before the fall.

About 1:30 a.m., a Dodge Stratus driven by Wade Briscoe, 21, of Lawrence, turned the corner on Ash Street and headed north on North Seventh Street. Briscoe ran over Davis, dragging him 56 feet.

Officers suspect Briscoe had been drinking alcohol, and tests were administered. Results of those tests are pending, and Briscoe has not been arrested or charged.

Davis was transported to Stormont-Vail Hospital in Topeka, but a condition update has not been available.

Its a sad story with a sad ending but pending the DUI results it still begs the question "How responsible am I whether or not there is any discernable level of alcohol in my system for running over some one who is laying in the street at 1:00 AM?"

truth: it won't matter.

It's illegal to drive while intoxicated whether you hit anyone/anything or not.

Granted, dude shouldn't have been laying in the street, so we can argue the culpability of the driver for the injury - but if his BAC was above .08, he'll be charged regardless of whether he's culpable for the injury or not.

You can't legally run over someone. If they are in the street you are expected to stop. If it is dark you should have your lights on and be able to see someone lying in the street and stop before hitting them.

It is impossible to figure that out from the report. I think I see what you are getting out, if the driver was just coming around the curve he had a much smaller window of opportunity to stop. Good question, and thank you for it as it reminds us of all the variables that go into making an accident happen.

DUI and Probability don't mix.

If you drive "over the limit", you may never get caught ... but, if you do it often enough, over a long enough period, the odds are that you will encounter something, like, say, a guy laying in the street just around a curve in the middle of the night. It might be your first DUI event, or your three-thousand-and-first, but at some point, the math catches up with you. I

I knew a guy once who was legally stopped along the side of a roadway, car running but not moving, and a young bicyclist who was racing other bicyclists looked back to check on his lead and ran into the legally stopped car ... hit the side-view mirror and trashed himself. The car driver called 911, an ambulance came, and so did some cops, one of whom smelled beer in the car, and the driver/parker ended up blowing a .081 .... Boom! DUI includes "parking under the influence."

Was the wreck his fault? Doesn't sound like it.
Did drinking by the driver make any difference? Probably not.

Will that matter? Nope.

It's all in the math.

I'm assuming his car didn't drive itself to the side of the road?
