Man faces 3 counts in bank robbery case

A 26-year-old Lawrence man will face trial on two counts of robbery and one count of attempted robbery, a Douglas County District Court judge ruled on Friday.

The ruling from District Judge Michael Malone settled two arguments between the defendant, Elliott Reid Werner, and prosecutors. Prosecutors accused Werner of robbing the Central National Bank, 603 W. Ninth St., on Nov. 30, 2011, and argued he should face two robbery counts because two tellers handed over money.

Malone also ruled that Werner should face trial for an attempted robbery count after bank employees previously testified that they noticed a suspicious man wearing a heavy jacket and ski mask walking away from the bank on Nov. 25. A police detective testified at a preliminary hearing that Werner told him that he had gone near the bank at least twice with the intent to rob it but that “he lost his nerve.” His attorneys had argued the circumstances did not meet the legal threshold for an attempted robbery.

Werner is scheduled to be arraigned on the charges during a hearing set for Tuesday.
