5th man charged, 6th arrested in gang rape

? Police on Tuesday arrested a sixth man they consider a main participant in the Oct. 24 gang rape of a 15-year-old student outside a Richmond high school dance, while prosecutors filed charges against a fifth person.

Richmond police raided a home Tuesday morning and arrested 21-year-old Elvis Torrentes without incident, police Lt. Mark Gagan said. Prosecutors will consider charges against Torrentes on Thursday.

Detectives used a probable cause arrest warrant; he is held in lieu of $1.25 million bail on suspicion of several sexual assault charges.

Later Tuesday, suspect Jose Carlos Montano, an 18-year-old Richmond resident arrested last week, wiped away tears as bailiffs escorted him into a Richmond courtroom for his first court appearance.

He was charged with rape in concert, rape by a foreign object in concert and an enhancement for personally committing a sexual act in concert, senior deputy district attorney David Brown said. Judge Peter Berger ordered Montano to return to court Tuesday for arraignment and to enter a plea.
