Victim’s family files wrongful death suit in connection with 2006 hit-and-run

A man convicted in a 2006 hit-and-run accident that killed a Kansas University student who was walking across Kentucky Street faces a wrongful death lawsuit filed by the victim’s father.

Michael Kanost is seeking in excess of $75,000 in damages from Joshua Walton, who was found guilty Feb. 11, 2008, of vehicular homicide and leaving the scene of an injury accident, both of which are misdemeanors.

Ryan Kanost, 22, was killed by a hit-and-run driver in the early morning hours of Sept. 23, 2006, as he walked across Kentucky Street at 13th Street. Walton contacted police the next day, after hearing Ryan Kanost had been killed.

Walton, Lawrence, was sentenced on March 24 to serve 90 days in jail and two years of supervised probation.

In the civil lawsuit filed Sept. 16 in Douglas County District Court, Michael Kanost claims Walton operated a 2002 Toyota Camry “in a negligent, reckless and wanton manner without regard for the safety of others,” and that he struck and killed Ryan Kanost.

The lawsuit accuses Walton of traveling too fast for conditions, speeding, failing to keep a proper lookout, driving inattentively, driving recklessly, failing to yield the right-of-way to pedestrians, driving while under the influence of alcohol and/or drugs, and leaving the scene of an injury accident without rendering assistance or contacting authorities.

Michael Kanost is seeking damages for expenses relating to his son’s death, and for other losses, including mental anguish, suffering and bereavement, which he claims exceed a total of $75,000.
