State’s law firm claiming victory in funding debate

Attorneys list case on Web site as a win

? The Kansas Supreme Court has found the school finance system unconstitutional and ordered the Legislature to increase school funding, possibly as much as $850 million.

But that hasn’t stopped the law firm that represented the state in its legal loss from claiming victory.

Lathrop & Gage, the private law firm hired by Atty. Gen. Phill Kline, to represent the state in the landmark school finance litigation, has listed the case on its Web site as a win.

The site www.beentherewonthat.com notes various parts of the case in which the state prevailed.

“Everything in that description is absolutely accurate,” said Tom Stewart, managing partner for the law firm. “From our perspective it is a substantial victory.”

In a previous ruling in January, the Kansas Supreme Court did dismiss several allegations against the state, and those are listed on the site.

They include the successful defense of the state against the charge that the school finance system violated the Equal Protection clause of the Kansas Constitution.

But the site makes no mention of the fact that the court has found the school finance system unconstitutional and on June 3 ordered the Legislature to increase school funding. Nor does it mention that lawmakers are in their first special legislative session in 16 years to address the ruling.
