Topeka man found guilty in DUI crash that injured Lawrence woman

A Douglas County jury on Tuesday found a Topeka man guilty in a drunk-driving crash that injured a Lawrence woman, the Douglas County District Attorney’s Office announced in a news release.

The man, Matthew David Zaitz, was found guilty of one count of aggravated battery and one count of driving under the influence.

The charges stemmed from an incident in the early-morning hours on Oct. 3, 2020, near the intersection of North 1500 Road and East 1750 Road. As the Journal-World reported, Zaitz, then 32, and a passenger, Heather Marie Heideman, then 35, were discovered injured after their vehicle had left the roadway and crashed in a nearby field. Both suffered serious injuries.

The State was represented by Senior Assistant District Attorney David Greenwald and Assistant District Attorney Paula Bustamante.

Judge Amy Hanley scheduled Zaitz to be sentenced at 1:30 p.m. on Jan. 10.

Zaitz faces 31 to 136 months in prison for his conviction of aggravated battery. He also faces 90 days to one year in the county jail and a fine between $1,750 and $2,500 for the DUI conviction, according to the DA’s office.
