Man sentenced to time served in DUI crash that injured child; still faces ICE hold

A Lawrence man who was arrested in May following a car crash that left his 7-year-old passenger with minor injuries was sentenced to time served Friday.
Emiliano Deaquino Salgado, 26, has remained in custody of the Douglas County Jail since his arrest on May 5.
The judge had granted him a $10,000 own-recognizance bond, but he had a hold through Immigration and Customs Enforcement, the Journal-World has reported. Senior Assistant District Attorney Alice Walker said during the sentencing hearing Friday that she anticipated that Salgado would be picked up on the ICE hold after the sentence was pronounced in the case.
Salgado entered pleas of no contest on Sept. 29 to charges of driving under the influence and aggravated endangerment of a child. The state dismissed a charge of aggravated battery as part of the plea agreement.
Lawrence police said at the time that Salgado rear-ended a car, which in turn struck another vehicle that was stopped at a red light at Clinton Parkway and Wakarusa Drive. Salgado’s blood alcohol content measured at .206 on a preliminary breath test, about 2 1/2 times the legal limit of .08, according to the probable cause affidavit supporting Salgado’s arrest.
The 7-year-old girl in Salgado’s car at the time of the crash was taken to Lawrence Memorial Hospital with minor injuries, the Journal-World has reported. The prosecutor said during Salgado’s plea hearing that the girl had suffered abrasions to her neck, shoulder and clavicle consistent with injuries from a seat belt.
District Court Judge Sally Pokorny on Friday sentenced Salgado to five months in jail for the endangerment of a child charge followed by 48 hours for the DUI, but he had already served almost six months. She also ordered Salgado to one year of post-release supervision through the Kansas Department of Corrections. She waived Salgado’s costs and attorney’s fees in the case.
Jail records still listed Salgado in custody as of early Friday evening.
