State asks federal judge to toss out Kansas Supreme Court nomination lawsuit

? Kansas has asked a federal judge to toss out a legal challenge to the way the state fills vacancies on its Supreme Court.

The lawsuit by four Kansas residents claims attorneys on the nominating commission have too much power because they make up the majority of the commission. They claim that is unconstitutional because it violates the voting rights of other residents.

A federal judge last week refused to issue an injunction barring such judicial appointments. The state argued in a court filing Friday that the entire case should be dismissed.

It notes other courts have rejected similar claims.
