Man convicted of his 2nd recent battery

A 47-year-old man received his second conviction in as many months Wednesday when a Douglas County jury found him guilty of battery.

Rufus Smith was already awaiting sentencing for a felony theft conviction he received in February.

His battery conviction stemmed from a Nov. 18, 2006, incident in which Smith was accused of stabbing an individual following an argument. The victim was treated and released from Lawrence Memorial Hospital.

Smith said during trial testimony that he had been defending himself.

His criminal record includes convictions for bad checks, thefts and drug possession.

He faces up to 12 months in Douglas County Jail for the latest conviction.

“This is an individual who just cannot conform to the rules of society,” said Charles Branson, Douglas County district attorney, in a statement. “We will keep trying Mr. Smith and he will change his behavior or spend a long time in jail.”
