Judge sets trial date for KU student’s lawsuit

A judge on Monday set a Feb. 27 trial date in a lawsuit filed by the family of a Kansas University freshman who suffered debilitating injuries when she fell from the roof of a campus-area house in October 2004.

The family of Sara Anne Driessel, who still is unable to walk and talk because of injuries she suffered from the fall, is suing David K. Jones and Misti L. Jones, of Lake Quivira, owners of the home at 1045 Tenn., and their son, Kyle, who lived there. The lawsuit alleges there was a party involving underage drinking the night of Driessel’s fall and that the owners should have known it was a dangerous “party house” where underage drinking was commonplace. They also claim the owners negligently failed to put a railing around a second-floor walk-out roof area where Driessel went to smoke a cigarette before her fall.

Driessel, who suffered severe head trauma and broken bones, has accumulated more than $1.6 million in medical bills, according to court documents.

Judge Robert Fairchild scheduled the trial date Monday in a brief hearing in District Court. A pretrial conference will be Jan. 18.
