Affidavit: Lawrence man molested girl with mental disability

The victim in a recently filed child molestation case was a girl with a mental disability, according to an affidavit prepared by police in support of the alleged abuser’s arrest.
Steven L. Capps, 39, was charged in July with two counts of rape and one count of aggravated criminal sodomy, all felonies, according to a complaint filed in Douglas County District Court. The complaint alleges that he assaulted a 14-year-old who was incapable of consenting because of mental deficiency or disease or because of the effect of alcohol or drugs.
Capps remains jailed on $250,000 bond, according to jail and court records.
The Journal-World requested the affidavit in support of his arrest and received it from the court this week.
Another adult caught Capps in a room with the girl and immediately called police, the officer who wrote the affidavit said in the document.
Using anatomical diagrams, the girl explained to police what Capps did to her and “indicated she was not a willing participant,” according to the affidavit. Although the girl “had difficulty communicating due to developmental disabilities,” she was able to clarify and correct information during her conversation with police.
Capps admitted to police that he removed the girl’s clothing and touched her inappropriately but denied raping her, according to the affidavit.
The Douglas County Sheriff’s Office denied the Journal-World’s request for Capps’ mugshot.
