Third person charged in December home-invasion robbery, shooting

A third person has been charged in connection with a December home-invasion robbery in which a man was shot.

Brian L. Proctor, 26, of Lawrence, was arrested, charged and made his first appearance in Douglas County District Court this week. Proctor is charged with aggravated robbery while armed with a gun and aggravated battery for allegedly causing great bodily harm to the man who was shot, both felonies.

Kayshunna C. Poindexter, 26, of Lawrence, and Jermel Fleming, 25, of Grandview, Mo., also have been charged with the same crimes in connection with the incident.

About 8:45 p.m. Dec. 20, 2017, robbers reportedly barged into an apartment in the 4500 block of Wimbledon Drive. A 21-year-old man who lived there was shot and flown to an area hospital for treatment; he survived.

The shooting victim told police he was at the apartment with his girlfriend when someone knocked at the door and asked for “Tim,” the Journal-World previously reported. When the victim told them that they must have the wrong house, someone said “run that (expletive)” and four suspects with handguns barged in.

Two suspects held the victim and his girlfriend on the first floor while the other two searched upstairs bedrooms.

The victim said the shortest suspect, whom other assailants called “Tink,” was the one who shot him. Police and prosecutors allege that “Tink” is Poindexter, who is 5 feet 3 inches according to jail records.

Poindexter was charged and arrested in January after an alleged domestic violence incident against her girlfriend. Poindexter remains jailed on $50,000 bond.

Since the December 2017 robbery, both Proctor and Fleming have allegedly committed other felonies.

In January, Proctor was charged with driving recklessly while fleeing police, a felony, according to court documents. In the same Jan. 13 incident, he also was charged with possessing marijuana and drug paraphernalia and driving with no license, misdemeanors, plus numerous traffic infractions.

In that case, Proctor posted $5,000 bond but failed to appear for a hearing, court records show. The judge issued a bench warrant; he was arrested again, and he posted bond again — this time $10,000 — to get out in early June.

Proctor’s bond in the robbery case is $25,000, according to court records. He remained in jail as of Thursday.

In January of this year, Fleming was charged with aggravated assault with a firearm, a felony, after allegedly pointing a gun at someone during a dispute in the 3300 block of Iowa Street. That case is pending.

Fleming was charged in the December 2017 home-invasion robbery last week. He is jailed on $100,000 bond.

As an 18-year-old, Fleming was convicted of aggravated robbery and other charges from a June 2010 home invasion in Lawrence, the Journal-World previously reported. He was sentenced to more than seven years in prison in that case with a possibility of early release. At that time, prosecutors said he already had three prior felony convictions.

Fleming was paroled to Missouri in October 2017, according to Kansas Department of Corrections records.
