Teen accused in sex crimes with underage girls considers withdrawing plea

A teen who previously pleaded no contest to sex crimes involving one or more underage women wants to consider withdrawing his plea.

Antonio Y. Martinez-Lopez, 19, of Yuma, Ariz., was to be sentenced Tuesday in Douglas County District Court. Instead he dismissed his attorney, saying that he wished to consult a new one about the possibility of withdrawing his plea.

Judge Kay Huff approved his attorney Sarah Swain’s withdrawal from the case and scheduled his next hearing for Oct. 14. She said if Martinez-Lopez and his family had not secured a new attorney at that time, a court-appointed one would be considered.

In June, Martinez-Lopez pleaded no contest to attempted rape, aggravated sexual battery and aggravated indecent solicitation of a child.

A no contest plea functions like a guilty plea in court, although the defendant does not necessarily admit to allegations as they are charged.

Martinez-Lopez was charged with a dozen crimes — including multiple counts of rape — that allegedly occurred before his 18th birthday and involved girls ages 16 and 13, the Journal-World previously reported. A number of those charges have since been dismissed.

He was initially charged as a juvenile, but Huff later ruled he met criteria to be tried as an adult.

Relatives of Martinez-Lopez who attended Tuesday’s hearing declined to comment on why he wanted to change his plea, saying they wanted to consult with the new attorney first.
