Wichita ? Kansas Gov. Sam Brownback has been dropped from a lawsuit challenging the constitutionality of a law that stripped federal funds from a Planned Parenthood chapter in the state.

U.S. District Judge J. Thomas Marten granted the request Tuesday after an earlier agreement between the state and Planned Parenthood of Kansas and Missouri to remove the governor as a named defendant.

The decision has no practical effect on the case because Robert Moser, the secretary for the Kansas Department of Health and Environment, is still named in the lawsuit.

The parties filed a stipulation Friday agreeing to the governor’s dismissal. Orders and findings in the lawsuit remain in effect, and all agreed not to seek damages or legal costs from each other.
